Gene that causes a form of deafness discovered

ScienceDaily (Sep. 30, 2012) ? Researchers at the University of Cincinnati and Cincinnati Children's Hospital Medical Center have found a new genetic mutation responsible for deafness and hearing loss associated with Usher syndrome type 1.

These findings, published in the Sept. 30 advance online edition of the journal Nature Genetics, could help researchers develop new therapeutic targets for those at risk for this syndrome.

Partners in the study included the National Institute on Deafness and other Communication Disorders (NIDCD), Baylor College of Medicine and the University of Kentucky.

Usher syndrome is a genetic defect that causes deafness, night-blindness and a loss of peripheral vision through the progressive degeneration of the retina.

"In this study, researchers were able to pinpoint the gene which caused deafness in Usher syndrome type 1 as well as deafness that is not associated with the syndrome through the genetic analysis of 57 humans from Pakistan and Turkey," says Zubair Ahmed, PhD, assistant professor of ophthalmology who conducts research at Cincinnati Children's and is the lead investigator on this study.

Ahmed says that a protein, called CIB2, which binds to calcium within a cell, is associated with deafness in Usher syndrome type 1 and non-syndromic hearing loss.

"To date, mutations affecting CIB2 are the most common and prevalent genetic cause of non-syndromic hearing loss in Pakistan," he says. "However, we have also found another mutation of the protein that contributes to deafness in Turkish populations.

"In animal models, CIB2 is found in the mechanosensory stereocilia of the inner ear -- hair cells, which respond to fluid motion and allow hearing and balance, and in retinal photoreceptor cells, which convert light into electrical signals in the eye, making it possible to see," says Saima Riazuddin, PhD, assistant professor in UC's department of otolaryngology who conducts research at Cincinnati Children's and is co-lead investigator on the study.

Researchers found that CIB2 staining is often brighter at shorter row stereocilia tips than the neighboring stereocilia of a longer row, where it may be involved in calcium signaling that regulates mechano-electrical transduction, a process by which the ear converts mechanical energy -- or energy of motion -- into a form of energy that the brain can recognize as sound.

"With this knowledge, we are one step closer to understanding the mechanism of mechano-electrical transduction and possibly finding a genetic target to prevent non-syndromic deafness as well as that associated with Usher syndrome type 1," Ahmed says.

Other researchers involved in the study include Thomas Friedman, PhD, and Inna Belyantseva, MD, PhD, from the NIDCD; Suzanne Leal, PhD, and her team at Baylor; and Gregory Frolenkov, PhD, and his team at the University of Kentucky.

This study was funded by the NIDCD, the National Science Foundation and the Research to Prevent Blindness Foundation.

The hardest part in getting a website off the ground purely for Google Adsense, known as a ?mini site?, is coming up with a topic that hasn?t already been done to death and then researching your keywords with the likes of WordTracker / Overture, and so on. In comparison, writing the content is a doddle?relatively.

Google Adsense is great; it?s basically free money once you have invested some time. If you already have a website that is selling a product, pasting some html code into the pages only takes minutes and you have paying ads immediately. But what we?re talking about here is Adsense-targeted pages.

Perhaps the best advice for copywriting for Adsense is to not provide the entire skinny on the topic you are writing about; simply give people a taster so that they will hopefully click a related ad on your page in thinking that the site they are clicking through to will teach them further.

Google doesn?t actually care how your copy is written. Google doesn?t penalise you for not mimicking the writing prowess of William Shakespeare. Google works by looking at the distribution of your keywords on the page, keyword density, is the keyword in the title and page name, and originality, and so on.

Aesthetically-speaking, the reason you want your site to look good is for the visitor, whom on pondering your site for the few nanoseconds it takes for the human brain to decide whether your site is any good or not, will stay there, browse the content and click on an ad if they feel enlightened.

You don?t particularly need to worry about making it pretty for return customers, as people who keep coming back to your pages are less likely to click on an ad anyway; which is the whole purpose of making the site in the first place. What you want are unique visitors to the site and to get them to click through.

A few basic tips on copywriting for Google Adsense:

The first couple of paragraphs are the most important, particularly the very first one. It?s great that you have written thousands of words on the subject that you know inside out, but unless you sound convincing on the first paragraph, there is a greater chance your visitor will hit the back button.

About 300 words per page is a good amount to aim for, which is about the optimum for getting the correct keyword density on a page. Any less than 200 words and Google, et al, will give that page less weight as it assumes, perhaps incorrectly, that you cannot possibly describe a topic with this meagre amount of words.

Your chosen keyword phrase should appear several times in the text, but not too much as that is considered spamming and will likely fetch you a penalty. A ball park figure is about twice in the first paragraph, twice in the last one and perhaps once in the other paragraphs; one or two of which should feature your chosen keyword phrase rewritten slightly differently.

Target only one keyword phrase per page ? it?s not a good idea to target single keywords, unless unique, as they are already very highly contested. Bold type the keywords a few times throughout the content; this will help the search engines and may also halt a roving eye. Use bullet points when listing several topics to break up the monotony of sentences and paragraphs; unlike the way this page is written.

Punctuation and grammar should be kept fairly tight, although, again, don?t kill yourself on this as Google won?t mind if you miss a comma here and there. As long as the copy is flowing and the reader doesn?t think you are a complete amateur. Just be mindful of your ?your? and ?you?re?, and your ?it?s? and ?its?, and so on, as faltering here really will make your site look amateurish.

Refrain from putting too many graphics on your pages, as many people are still on dial-up and any longer than a few seconds for your page to load up and it is likely the visitor will hit the back button. Same goes for those pages with the likes of ?Enter Site Here? once you have already clicked through from the SERPs?annoying to say the least.

Following these basic pointers will help you construct copy for attracting Google Ads more efficiently, but if you are selling a product on your site, you will need the copy to sound as enticing as possible to attract the visitor and to keep them coming back.

It goes without saying, however, that many people will even struggle with copywriting for Adsense, let alone for a site that needs to sound professional and refined. By far the easiest way to get your site off the ground in this case, is to acquire the services of a professional copywriting website and also have them do your SEO (search engine optimization) to help get your pages up in the rankings quickly.

Don?t Hate the Player: NCAA ?13 Preview of Northwestern vs. Indiana

WNUR Sports Social Media Director Cameron Songer (@CameronSonger) uses NCAA Football ?13 to predict the outcome of the Northwestern Wildcat?s match-up with the Indiana Hoosiers this Saturday.

Conference games in the Big Ten get started this week, and the virtual Wildcats are set to take on the Hoosiers. In real life, Northwestern beat Indiana easily last year. However, this simulated season is almost nothing like real life. Alabama, for instance, enters week 5 of the simulated season with the same record as Northwestern (2-2), while Indiana is 3-0.

As always, I?ll use NCAA Football 13?s SuperSim function under default settings to determine the winner of Northwestern?s weekly game. Then, I?ll look at what else is happening in the simulated season. You?ll notice that the rankings don?t always match up with real life. This is a result of my simulated 2012 season running independently from real life.

LB David Nwabusi (SR): 87 Overall, 92 tackling

Northwestern Game Recap

Neither team scored on their first possession, but Northwestern was able to capitalize on an interception. A Jeff Budzien field goal scored the first points of the game. Neither offense could really get going in the first quarter, which ended with a 3-0 Northwestern lead.

The Hoosiers had -4 yards rushing and only three first downs through one quarter. Northwestern began the second quarter inside Indiana territory in the midst of a drive. Two plays into the quarter, Treyvon Green turned the ball over on a fumble and the defensive chess match continued. Northwestern at least appeared to be winning the battle for field position, especially after a punt gave Indiana the ball on their own 3 yard line with two minutes to play in the half. Four plays later, with the ball on their own 15, sophomore Cody Latimer hauled in an 85-yard touchdown pass to put IU up 7-3.

Indiana would take that four-point lead into halftime. Each team turned the ball over once in the first half, but Northwestern?s offense showed much better balance than Indiana?s, which had only 6 rushing yards in the first half.

Northwestern?s defense, as they did in previous simulated games, allowed a touchdown on the first drive of the second half. The 11-play, 82-yard drive ended with a short QB sneak that gave the Hoosiers a 13-3 lead due to a missed extra point. The Wildcats came back with their own 71-yard drive in 9 plays to cut the lead to 3. With the offensive units from both teams warming up, this game had all the makings of a ?Cardiac ?Cats? special.

Indiana went three-and-out on their next possession and Northwestern moved the ball down the field using the running game. Kain Colter made some nice moves to avoid defenders in the backfield, but the big play again eluded the ?Cats. The drive stalled and the ensuing 28-yard field goal missed.

The score remained 13-10 early in the fourth quarter. Indiana came out running the no-huddle and trying to put the game out of reach. They moved the ball into Northwestern territory thanks to a 33-yard scamper by their QB, but failed on a fourth-and-seven attempt from the NU 33 yard line.

Northwestern moved the ball up the field again in crunch time, but a holding penalty at the Indiana 14 yard line crushed Northwestern?s touchdown chances. Jeff Budzien nailed a 41-yard field goal to tie the game with a little over a minute to play. Indiana took over at their own 25 with all three of their timeouts remaining. With the freedom of being able to call a timeout, Indiana opted to try rushing the ball. This strategy backfired, resulting in a three-and-out.

With the score locked at 13-13 and 48 seconds left on the clock, Northwestern started the most important drive of the game from their own 20 and 2 timeouts. Of course, Northwestern came out throwing the ball, which earned one first down. On the fourth play of the drive, Kain Colter didn?t find anyone open, so he tried to scramble up the field. He took a huge hit and fumbled the ball. Indiana recovered at Northwestern?s 36 yard line. They couldn?t advance the ball inside the 30 and opted to go for a touchdown rather than a long field goal as time expired. The Hail Mary pass sailed long, sending the game to overtime.

In overtime, Kain Colter ran for 16 yards on the first play. Two plays later, on third and goal, he connected on a seven-yard pass to Kyle Prater. Indiana?s overtime possession came down to a 4th-and-20 that came up just inches short.

Final Thoughts

Northwestern somehow escaped with a 20-13 win in overtime, but it wasn?t always pretty. Northwestern barely outgained Indiana. In a battle of dual-threat quarterbacks, Kain Colter and Indiana?s Tre Roberson played to a draw. They each threw for over 200 yards and rushed for nearly another 50. Individual statistics aside, the Wildcat defense came through in the clutch, holding Indiana to a 16% success rate on third downs. Finding ways to win close games is a Northwestern tradition? one that is captured in the game a little bit too well.

Conference play got started this weekend, but there really wasn?t too much to get excited about. Illinois knocked off Penn State and Michigan State improved to 5-0 with a win over Ohio State. Iowa also improved to 5-0 by defeating a Minnesota team that started the season well. Purdue won a non-conference matchup against Marshall. The game of the week in the Big Ten was Nebraska defending its home turf against Wisconsin. Both teams are now 4-1. Michigan (3-1 overall) had a bye.

Fatal motorcycle accident on I-10 near Canal Street, station reports ...

WWL-TV is reporting that a motorcyclist was thrown off his bike and killed while on Interstate 10 westbound near Canal Street early Friday morning. The 29-year-old driver was leaving the French Quarter about 4 a.m. as part of a group on motorcycles, according to the report.

The fatality occurred when the driver hit the left guardrail on the Claiborne Avenue "flyover ramp" and he plunged 38 feet to his death, according to the station.

The investigation of the accident closed two westbound lanes of the interstate for a couple of hours. All lanes are now open.

Fire destroys single mom's business, retirement plans - Financial Post

Situation: Fire devastated family business and home of divorced woman

Strategy: Get insurance settlement and a job, invest for retirement

Solution: Retirement income two-thirds more than pre-fire salary

Trouble, it is said, comes in threes. The case of a woman we?ll call Judy, 50, appears to prove the rule. Recently divorced, she found her home destroyed by fire and her source of income terminated.

Judy owned, lived in and ran a ski lodge in Alberta until it was burned to the ground in an electrical fire in late 2010.

A seasonal operation with 15 rooms, it barely broke even after paying Judy a $48,000 annual pre-tax salary. She had insurance, of course, but it was a low-cost package that did not cover loss of business or provide for full replacement cost of the lodge.

So instead of paying out potentially millions it would take to rebuild at today?s prices, she will be left with an insurance settlement of $400,000 and the lot where the lodge used to be, which is worth about $75,000.

There is no money to rebuild the lodge. Judy has moved to a rental apartment in Vancouver and is looking for a new job. There won?t be any payment for loss of business, which was a break-even operation to begin with.

So far she has received $200,000, which she is using to supplement the $1,212 she gets every month from employment insurance. In the expensive Vancouver housing market, her settlement may not even be enough to buy her a new home.

With twin sons in university and her own retirement to consider, she is nervous.

?What do I do now?? Judy asks. ?I could buy another home, but that is impossible in Vancouver. Investing everything scares the heck out of me. I need a plan but don?t know where to start. I am still frightened by what happened and I have planning paralysis.?

Family Finance asked Derek Moran, head of Smarter Financial Planning Ltd. in Kelowna, B.C., to work with Judy. In his view, she can solve her problems if she can get a new job, perhaps in hotel management, and make sensible investments. It will take a series of steps, he says.

Cash management

Mr. Moran suggests a couple of first steps: Put $10,000 of her $175,670 cash ? what?s left after paying some of her transitional living costs and replacing clothing and other goods ? into her tax-free savings account.

Second, pay off a $5,000 line of credit with a 7.5% interest rate.

Third, sell a $40,000 building lot to her ex-husband via a vendor-take-back mortgage. If he misses a payment, she gets the lot back. The deal is not without risk, for if the market price of the lot were to drop and he missed payments, she would be left with an asset of reduced value.

A sale is pending of the $75,000 lot where the lodge once stood.

Judy can make several economies. She allocates $450 a month to her sons? educations on top of income from their $38,000 trust accounts. Yet each son can make $225 a month with part-time work. Her $650-a-month spending for clothing covers replacement of her wardrobe, which was lost in the fire. It will be reduced over time.

Judy can apply the skills she used in many years of ski lodge management to running a conventional hotel or another lodge. She expects to replicate the $48,000 annual salary when, soon, she expects to have full-time work.

She can eliminate $200 a month for the cost of her line of credit, $450 for university costs, $253 for property taxes on the lots, $650 for clothing expenses, and $350 a month for keeping her horse (due to be sold).

Remaining expenses, including a normalized budget of $200 a month for clothing and grooming, would add up to $3,535 a month. If her retirement income after tax can produce that amount, her retirement would be adequately financed and, with a bit of financial engineering, some capital would be preserved for her sons to inherit.

Retirement

If she invests in high-quality corporate bonds or dividend-paying stocks that generate a conservative return of 2% after inflation and income taxes, her assets of $527,670 (including her insurance settlement) would grow to $739,000 in 17 years when, at 67, her Old Age Security begins. In retirement, that capital could generate 3% or $22,170 after average 10% income tax. All figures are in 2012 dollars.

If Judy is prepared to exhaust her capital in 25 years to age 90, her financial assets could generate $47,000 a year to age 90, Mr. Moran estimates. Judy is on track to earn full Canada Pension Plan benefits at 65 of $11,840 a year. She will also receive $6,540 in Old Age Security at age 67. Her gross income at age 67, assuming capital exhaustion by age 90, would total $65,380. or $4,900 a month, after 10% income tax.

If Judy gets a job and is able to save $10,000 a year out of salary and investment income until she is 67 and her OAS begins, she could grow $204,000 additional capital by 65. In retirement, that money could generate $6,120 a year at 3% before tax. If this capital is not exhausted, it could be a legacy for her children. In this case, Judy?s total pre-tax annual income would rise to nearly $71,500 a year, or $5,363 a month, after 10% tax.

In spite of the fire and its destruction of her way of life, her after-tax retirement income in 2012 dollars would be 1.7 times more than her annual salary before the blaze. She could easily cover expenses less the cost of stabling and feeding her horse, which is due to be sold, debt service and university expenses for her sons.

There are a lot of ifs in these projections, Mr. Moran admits. Judy should be able to get a job in hotel management. The final insurance settlement of $200,000 is probable, but at the moment, the money is just a contingent asset.

She could also choose to use some of the insurance money for a down payment on another house where she finds permanent work. In that case, her $1,400 monthly rent payments could be spent on mortgage payments. Utilities and upkeep would add to that, but it?s her future choice.

Nevertheless, Judy is, as Mr. Moran says, by nature a saver. ?If she can invest wisely and work to cover living expenses and to provide a margin for saving, she should be able to have a comfortable retirement,? he says.

(AP) ? The suspect in the Aurora movie shooting case mailed "burnt currency," along with a notebook, to his psychiatrist before the attack. He threatened a professor and was banned from a university campus before withdrawing from its neuroscience graduate program. His defense team has added a psychiatrist.

Those were the few tidbits of information in hundreds of pages of heavily-redacted court documents released Friday, which serve as the best chance the public has to understand what happened before James Holmes allegedly opened fire at a midnight screening of the new Batman movie more than two months ago.

The documents shed little light on Holmes' possible motives or whether the university ignored warning signs about him. That's partly because Arapahoe County District Judge William B. Sylvester continued to keep under seal the key documents in the case ? the affidavit that lays out prosecutors' case against Holmes, and the search warrants that allowed them to gather evidence against him.

Holmes, 24, faces 152 charges in the July 20 shooting that killed 12 people and injured 58 others.

Some of the documents are entirely blacked out. In others, Sylvester's rulings on legal disputes, references to years-old case law and even copies of newspaper articles are redacted, along with information about the investigation.

The documents do shed a little more light on one of the main disputes in the case ? Holmes' threats against a professor, possibly the university psychiatrist, Dr. Lynne Fenton, who has testified that she contacted campus police after her last meeting with Holmes June 11. Fenton, who testified Aug. 30, said she went to police to gather more information and communicate her "concern."

She did not refer to her concern as a threat.

Prosecutors contended that Holmes was barred from campus after making the threats. The University of Colorado has said that Holmes was denied access to nonpublic buildings on campus because he withdrew as a neuroscience graduate student, not for safety reasons.

A university spokeswoman did not return a call for comment on Friday. The university has previously refused to comment on how it handled Holmes, citing a gag order that Sylvester imposed. Before the gag order, university officials said their police force had no contact with Holmes and that the chief of the department knew nothing about him.

The defense team sought sanctions against prosecutors for contending Holmes had been barred from campus, arguing that the false statements could contaminate the jury pool. But Sylvester shot that down, ruling the statements were within legal bounds.

Defense attorneys did not return a call for comment Friday.

The most legally significant disclosure Friday was the inclusion of the psychiatrist on Holmes' defense team. Holmes' attorneys have said he is mentally ill.

"This is unusual in a normal case, but not surprising in this case," said criminal trial lawyer Dan Recht, former president of the Colorado Criminal Defense Bar. "Presumably he's (the psychiatrist) the one who is going to opine on whether Holmes is insane or not.

"It's a foregone conclusion that the defense will plead not guilty by reason of insanity."

Other documents likely contain new information, but are blacked out. For example, in one pleading, attorneys describe how law enforcement handled the package that Holmes sent Fenton, which was discovered four days after the attack and also after Holmes allegedly booby-trapped his own apartment.

Authorities were so worried the package was also rigged that they X-rayed it and had a technician in a protective suit open it. What investigators saw when they realized the package was not dangerous, however, is redacted. All that is legible in the documents is a reference to the package containing a notebook with a post-it note and "burnt currency."

The records also show that authorities obtained text messages that Holmes sent a classmate. The documents do not say what those texts discussed.

In court, prosecutors suggested Holmes was angry at the failure of a once promising academic career and stockpiled weapons, ammunition, tear gas grenades, and body armor as his research deteriorated and professors urged him to get into another profession. Chief Deputy District Attorney Karen Pearson said Holmes failed a key oral exam in June, was banned from campus and began to voluntarily withdraw from the school.

Documents filed in the case from now on will be public, unless prosecutors or defense attorneys ask they not be released.

I like to spookify a section of our house every year while the kids are at school, they love the surprise when they come home.? One year I painted a ghost on the mirror above the mantel, and another year I made glowing eyes Halloween art.

This year I decided that while they were away, big black spiders would invade the family room bookcases, and bring some feathered friends.? Since I painted the built ins white this year, they were the perfect candidate for some black and white Halloween fun.

The glittery spider webs were a DIY project and I used craft supplies from Martha Stewart?s collection to create them.

To make them, all you need is wax paper, craft glue, and some black glitter, scissors to trim the wax paper, and a Xacto knife to cut them out in the end (not shown).

Sketch the web design with a marker or freehand it like I did with craft glue.? Scatter glitter on top to form the glittery web and allow to dry for 24 hours.

Once the webs have dried, trim between the webbing carefully with a Xacto knife or craft cutter on top of a cutting board.

I used these inexpensive foam mounting dots to adhere the webs to the bookshelves, but if your shelves are not white, clear glue dots should work too.

I learned the thinner your line of glue the more delicate the web is but it can get unstable if too thin, so keep your glue line thicker for a sturdier web that can span 12-16 inches.

Scientists capture clues to sustainability of fish populations

ScienceDaily (Sep. 27, 2012) ? Thanks to studies of a fish that gives birth to live young and is not fished commercially, scientists at UC Santa Barbara have discovered that food availability is a critical limiting factor in the health of fish populations.

The scientists were able to attach numbers to this idea, based on 16 years of data. They discovered that the availability of enough food can drive up to a 10-fold increase in the per capita birthrate of fish. And, with adequate food, the young are up to 10 times more likely to survive than those without it.

This research, published this week in the Proceedings of the Royal Society B, is expected to be useful for managers involved in maintaining sustainable fisheries.

The scientists used a remarkable set of black surfperch population data -- collected from 1993 to 2008 -- to develop these statistics. Divers collected the data by monitoring a fish population off Santa Cruz Island, near Santa Barbara. Russell J. Schmitt and Sally J. Holbrook, both professors in UCSB's Department of Ecology, Evolution, and Marine Biology and UCSB's Marine Science Institute, head the team of scientists.

First author Daniel K. Okamoto, a Ph.D. student in UCSB's Department of Ecology, Evolution, and Marine Biology, explained that there has been a lack of information about how survival and birthrates are influenced by food availability, which is known to fluctuate through time. Black surfperch, found off the Pacific Coast from central Baja California northward to Fort Bragg, feed on small crustaceans and worms.

"If a management procedure has called for a certain harvest rate that is constant through time, that would be like saying we should harvest the same amount of corn through time, even though we know that corn can be influenced by things like drought," said Okamoto.

The scientists consider the black surfperch (Embiotoca jacksoni) to be a model species because it is not fished commercially, making it easier to assess the effects of food availability on fish mortality and reproduction.

A key feature of the black surfperch is the fact that this fish gives birth to live young that remain on the reef, allowing for its population to be counted accurately from year to year.

"The individual fish stay on their natal reef; they have low emigration- immigration rates, so we can actually track cohorts through time," said Okamoto. "An adult gives birth to live, capable young, instead of laying eggs. Those young stay on the reef where the adults were, which is a really nice property. We can go to a reef in a given year, survey it for adults, then go to that reef again the next year and see the young that are there and know, for the most part, that those young came from the adults that were there the year before." By contrast, most fish are dispersed into open water when they are in the larval stage.

Okamoto said that not including food availability in calculating benchmarks for species conservation may leave out a critical element in fisheries management.

Daniel Reed, a research biologist with UCSB's Marine Science Institute and the principal investigator for the Santa Barbara Coastal Long Term Ecological Research Program, is also a co-author of the study. The National Science Foundation provided funding for the research.

Conservatives pour new money into 6 Senate races

WASHINGTON (AP) ? A conservative super PAC has jumped back into the Indiana Senate race with a nearly $1 million ad buy highlighting Democratic nominee Joe Donnelly's support for two of President Barack Obama's policies.

The Indiana buy is part of more than $6.4 million worth of air time that Crossroads GPS and American Crossroads bought this week in six Senate contests, according to Federal Election Commission records. The money also was dedicated to races in Florida, Ohio, Virginia, Nevada and Wisconsin.

Indiana, while appearing firmly in the GOP column, is emerging as a battleground state for control of the Senate.

Donnelly's opponent is Republican Richard Mourdock.

Crossroads GPS criticized Donnelly for voting for Obama's economic stimulus and health care overhaul. Donnelly's campaign said he supports making changes to the health care law.

What Can I Do If It Does Not Appear That The Selling Agent Is ...

Q: My neighbor is selling her home through a local agent. The agent inspected the home and it was listed for approx $3500.00 above property appraiser value which was suspect at best. Thinking the seller just wanted a quick sale I brushed it off. The home had not been on the market more than 3 days when a couple made an offer. I am not certain if the offer had been accept prior to or in conjunction with the couple?s request that certain electrical work be done as part of the offer, which the seller agreed to and had done. Then 4 days before the closing the couple unbeknown to the seller had a septic company come to check the septic system which should have been cleared during the inspection. The next thing I hear from the seller is that she is having the drain field replaced because the couple and the realtor are telling her it needs replacing. I believe the sellers? agent is not representing her clients? best interest. I have been a neighbor for nearly 15 yrs and I am certain the drain field is fine but cannot convince the seller to get her own estimates. I feel the seller is being scammed and the agent is allowing it to go on. Between the cost of a new drain field and the electrical work already done the seller is way below property appraiser value. The seller is in her 70s and I am not sure if she?s just desperate to sell or may not realize what is happening. What if anything should I do as it upsets me to see that not even her agent is doing anything in the sellers? interest.

A: Your first response was the best one! We should never take one Inspectors opinion when it comes to a huge repair cost like a septic system. Your Neighbor should have some one she has been dealing with for the years she has owned the home, that?s been maintaining the septic tank. She would be able to get information as to their records of any prior problems with this system as well as get a second or third opinion from other Inspectors. Most Legal Real Estate contracts cover this in a chapter (13,in ours) of the contract relating to sellers responsibility or agreement of repairs and usually it has a 1% cap meaning the seller is to provide repairs up to one percent of the sales price only, anything out side this CAP must be negotiated and is not a required repair. Since the seller is in a state of panic it would also help to call the listing company?s number off the sign and speak to the Principle Broker there. They are in charge of all the contracts that go through their office and if you have a complaint they would be the one to speak to and address any concerns. In this case it would also help you to know the final outcome and sales price as this could adversely affect your homes value as well should you decide to sell your home. I commend you for being such a great neighbor!
